The Bar Association Welcomes New President Dr Simon Foote KC

The New Zealand Bar Association | Ngā Ahorangi Motuhake o te Ture welcomes our new President, Dr Simon Foote KC.

Simon succeeds Paul David KC after a two-year term that saw our Association navigate a range of significant issues affecting both the bar and the wider justice system.

Simon has been part of the independent bar for 24 years and has served the Association in a variety of leadership and governance roles.

Simon practises from Bankside Chambers, one of Aotearoa New Zealand's leading sets of independent barristers, arbitrators and mediators. His practice spans commercial and civil litigation, arbitration, public law and criminal jury trials. He also holds a PhD in law, with research focused on jurisdictional aspects of investment treaty arbitration.

Simon says his presidency will focus on the people who make up the independent bar, and the role they play in the justice system.

"These are dynamic times for the independent bar. It has grown and diversified markedly since I became a barrister in 2002."

Simon reflects that growth has strengthened the influence of the independent bar while increasing the Association's responsibilities to its members and the justice system.

"As a result, our role in the justice system is ever more important and the Association's obligations to its members and its opportunities to promote its objectives have likewise increased considerably.

"I am excited to lead the Association in supporting its members through education, professional growth, practice development and wellbeing, while continuing our work to promote and protect the rule of law and improve access to justice."

A longstanding advocate for access to justice, Simon co-authored the Association's 2018 report on the issue and later established the Access to Justice Award to help keep access to justice at the forefront of professional discussion.

Looking ahead, Simon says he wants to hear directly from barristers around the country and to work with the wider profession for our mutual benefit.

"I look forward to working with barristers throughout Aotearoa to better understand their challenges, support their work, and strengthen their connection with the Association. I hope to meet and engage with as many members as possible over the next two years."

The Association would also like to recognise outgoing President Paul David KC of Eldon Chambers. Paul was a conscientious and highly respected leader who guided the organisation through a number of complex and challenging issues during his two-year term. Reflecting on his time in office, Paul said his belief in the importance of the independent bar remains as strong as ever.

"I strongly believe in the role of the independent bar in supporting the effective functioning of our system of justice.

There is still much work to do in explaining the role of barristers and the work they do in providing a civilised form of dispute resolution in the courts and tribunals of New Zealand.   More generally, we must continue to demonstrate the independence and fairness that are essential to our justice system.”

While acknowledging the demands of the role, Paul said it had been immensely rewarding.

"I have enjoyed my time serving as President. I am pleased that I put myself forward for election. The role is challenging, but I have found it very satisfying.

I tried to maintain a full schedule in my practice during my term, which was made possible with support from my family, particularly my wife June, the team at the Association, members of the Management Committee and Council, and my colleagues at Eldon Chambers. I thank everyone who helped me to do the job.

I look forward to contributing to the Association in the years ahead, and I wish Simon the very best in the role.”

Paul will remain involved with the Association as Immediate Past President, providing continuity and support during the transition.
