This webinar will focus on arbitration’s essential, foundational concepts.  It is designed as a “how-to guide” for preparing and conducting an arbitration. The webinar will cover what you need to know about arbitrations and also what steps you need to take throughout the preparation for an appearance at an arbitration.  It is practically focused.  

The webinar is aimed at Junior and Intermediate practitioners, as well as those unfamiliar with this area of practice but wishing to learn how an arbitration works, its fundamentals and how to guide a client through an arbitration.   It is also suitable for those looking for a refresher. 

Our experienced presenters – Dr Anna KirkTimothy Lindsay and chair, Damian Chesterman will discuss key topics including an overview of the Arbitration Act, the significance of the Arbitration Agreement, how to appoint an arbitrator, preparing for the first procedural conference and how to conduct the arbitration.  They will take you through all of the fundamental skills you need for an arbitral hearing.

OUR PRESENTERS

Dr Anna Kirk is a commercial arbitrator, adjudicator and barrister, specialising in international arbitration and public international law. Anna is the Vice-President of AMINZ and New Zealand's member on the ICC International Court of Arbitration.

Anna has almost 20 years’ experience in both international and domestic arbitration, having previously practiced in London and with Sir David Williams KC. She is regularly appointed as arbitrator in domestic arbitrations, and her recent counsel work includes representing parties in the Permanent Court of Arbitration in The Hague.

Anna teaches international arbitration at the University of Auckland, is co-author of Williams & Kawharu on Arbitration and has a PhD in international law from the University of Cambridge.

Timothy (Tim) Lindsay is a commercial litigator and arbitration counsel, and a founding partner of Lindsay Francis & Mangan, a specialist business disputes law firm with offices in Auckland, Singapore and Sydney.  He was previously a partner at US law firm Dechert LLP, where he headed the firm’s international arbitration practice in London.  

Tim is globally recognised for his more than 20-year track record as counsel in large, complex and “bet the company” disputes, across commercial and corporate/securities litigation, class actions, regulatory defence, and arbitration matters.  In his arbitration practice, Tim has appeared in arbitrations under all of the major rules, in particular the ICC, LCIA, SIAC, UNCITRAL and ICSID, as well as at AMINZ.  He is a member of the ICC New Zealand Committee, a past member of the ICC Court of Arbitration, a past member of the ICC Commission on Arbitration, and a member of the drafting committee for the first edition of the AMINZ Arbitration Rules.  
  
Tim practices from his firm’s Auckland and Sydney offices.  He appears as counsel in international arbitrations seated in Singapore and internationally.

Damian Chesterman is a commercial and civil barrister and arbitrator with over 25 years of litigation and arbitration experience both in New Zealand and internationally.   Damian has been involved in domestic and international arbitrations both as arbitrator and counsel.  Damian’s interest in arbitration was sparked in 1998 through an International Arbitration paper within the LLM degree at the University of Cambridge and he has remained involved in arbitration ever since.  Damian completed his fellowship in arbitration with AMINZ in 2018.

Damian has developed a broad-based practice in the areas of contract, land, equity, insolvency, company law, defamation and relationship property.  He is also experienced in respect of issues affecting Maori including fiduciary duties of trustees of Maori Trusts and issues arising from Treaty settlements.   Damian regularly presents at seminars on the topics of civil litigation and arbitration.  Damian volunteers his time as a member of the NZBA Training Committee, as a faculty member for the NZLS Litigation Skills Courses and contributes to commercial law reform as a member of the NZLS Commercial and Business Law Committee.   Damian provides Civil Legal Aid services and pro bono advice to contribute to access to justice

Damian’s qualifications include an LLM (Hons) from the University of Cambridge, England; an LLB with First Class Honours from the University of Waikato; a B.Com from the University of Auckland; New Zealand’s highest qualification in arbitration (FAMINZ (Arb)); admission to the New York Bar and admissions in Australia, England and New Zealand.
