Does compromise, compromise justice? Three proposals for the integration of mediation and the Court process | CPD 1.5hrs

In 2022, the Rules Committee issued their report ‘Improving Access to Civil Justice’ which set out the Committee’s recommendations for addressing the various barriers to accessing justice in New Zealand. This report led to consideration of the role mediation could play in improving access to institutional justice.

This discussion, chaired by Maria Dew KC, involves Hayden Wilson (Partner, Dentons) and Madison Dobie (Senior Associate, Dentons) who present their proposals for how mediation could be integrated into the institutionalised system of civil justice to improve access to those institutions. The aim behind these proposals is to ensure that the Court remains the ultimate arbiter of the dispute, but mediation assists with clearing the noise and allowing the Court to undertake its important function.
