How to Manage Complaints and Claims Against Barristers and Litigation Lawyers (CPD 1 hr)

Watching this recorded webinar is a bit like having insurance.  You think you don't need it until you need it. And then you wish you were prepared.

It may never happen to you – if you are lucky. But there has been a sea change for barristers and litigators, who are facing claims and complaints at a higher rate than before. If you are unlucky, a missed deadline, a client who expected more than what they got, or even cyber-attacks can result in a claim and the stress that goes with it.  Complaints, in particular, are on the rise - including complaints from the other parties to the litigation.

The smart lawyer will be prepared and will understand how their personal indemnity insurance can help, including what to look for in cover, and what the first step is when a claim or complaint is made against them (stand back from that keyboard!).

This webinar will use real life examples of where practitioners have faced claims or complaints, and how their insurer and lawyer have helped to navigate the process. It will set out the steps they should take from the outset if they find yourself on the receiving end of a professional claim.

The presentation is chaired by barrister Michael Webb, (who led the recent review of the Marsh/New Zealand Bar Association | Ngā Ahorangi Motuhake o te Ture Professional l Indemnity Insurance scheme). Our presenters are Michael Robertson, Partner of Robertsons Law, who specialises in professional indemnity claims and insurance litigation, and  Nigel Grantham, Chairman of Specialty, leads the Marsh team responsible for the PI Scheme.

Our Presenters:

Michael Robertson

Michael is one of New Zealand’s leading insurance litigation lawyers.   He has practised in insurance law since 1988 and over that period of time has acted for most of the New Zealand insurers and managing general agencies, brokers and a broad range of international insurers, including numerous Lloyd’s Syndicates.  Michael specialises in professional indemnity, general liability and directors and officers insurance, with a particular focus on claims against lawyers, accountants and construction professionals and defending regulatory claims.  He has a wealth of experience drafting and advising on all types of insurance policies, including complex combined liability policies, and bespoke policies and endorsements. He provides risk management services and claims resolution advice across a wide range of professions and industries.  

Michael has a Master’s Degree in Commercial Law with first class honours majoring in insurance.  He frequently presents to professional groups, insurers and brokers.  Michael is also an associate of the Arbitrators and Mediators Institute of New Zealand.  Michael is ranked as an Asia Pacific “Hall of Fame” lawyer in Legal 500.

 

Nigel Grantham 

Nigel has specialised in liability insurance for 30 years. 
He has also worked in the London market for 8 years negotiating International Professional Indemnity cover for various professions both within the Lloyds market and London Company market. 

Additionally, he has travelled (pre covid) to the UK twice a year to negotiate and place 3 of the 4 largest law firms in New Zealand and the largest consulting engineer in New Zealand. This has allowed him to keep abreast of developments within the London market first hand and continue to build the long standing relationships with underwriters. 

Nigel has been involved in negotiating and placing some of the largest infrastructure construction projects in NZ over the last 30 years. 

He also has experience in handling and structuring significant D&O placements for plc’s and large private companies, and dealt with numerous capital raising insurance requirements, M&A’s and IPO’s for clients. 

In 2010 Nigel was awarded insurance broker of the year; an achievement recognised through his contribution to the insurance industry and through client feedback. 

Michael Webb

Michael is a barrister with a wide ranging practice in corporate, financial markets and government law. His work includes advice and representation in complex or sensitive matters and negotiations, independent reviews and investigations, and policy and law reform in New Zealand and internationally.  He also brings to his work extensive regulatory and governance experience, including  as a foundation  board member of the Financial Markets Authority, and as a board member of significant public and private sector entities. Michael has been leading the review of the Professional Indemnity Scheme available for Bar Association members.
