New Environment Court Practice Note 2014 - effective 1 December 2014
The Environment Court is releasing a new Practice Note which will come into force on 1 December 2014 and will replace earlier practice notes. The Court notes that it is not a set of inflexible rules, but that it is to be followed unless there is good reason to do otherwise.
The more significant changes to the Practice Note include a new section on Direct Referrals; cooperation required in the preparation of evidence; requirements concerning statements of evidence; alternative dispute resolution including mediation (including a requirement that parties be represented at ADR sessions by persons holding full authority to settle); a new Appendix concerning lodgement and use of electronic versions of documents; an Appendix containing an updated Protocol for Court-assisted mediation; and an Appendix containing a Protocol for Expert witness conferences.
